General Terms and Conditions

This document ( General Conditions of Sale ) defines the conditions applicable to sales concluded between on the one hand people making a purchase via the HUMAYA website, hereinafter referred to as "Customer" and on the other hand the HUMAYA company.


These conditions apply exclusively to non-commercial individuals.


These conditions apply to the exclusion of all other conditions, in particular those in force for in-store sales.


These general conditions of sale only concern non-commercial individuals aged at least 18 years old.


The customer is understood as any natural person who acts for purposes which do not fall within the scope of his commercial, industrial, artisanal or liberal activity, aged at least 18 years and having ordered at least once on the site.


The creation of a customer account is reserved for all individuals aged at least 18 years.


The General Terms and Conditions applicable to the order of an item by a customer are those in force on the day of the order.


If any of the provisions of these general conditions of sale is declared void in whole or in part, the other provisions and the other rights and obligations arising from these general conditions will remain unchanged and will remain applicable.


Each HUMAYA product is presented on a specific page.

We strive to represent product characteristics as closely as possible to reality.

Before placing an order, we invite you to carefully study the description and characteristics of the product.


All item prices are indicated in euros (€) all taxes included, excluding processing and shipping costs (see Shipping and Delivery paragraph) or any possible additional costs.


These additional costs will be added to the order summary page before final validation and will also appear on the Order confirmation page.


Items will be invoiced based on the rates in effect at the time the orders are placed. They remain the property of HUMAYA until full payment of the price.


This price is payable in full and in a single payment.

Any order on the site and delivered outside France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination.


These customs duties and possible taxes linked to the delivery of an item are the responsibility of the customer and are their responsibility. HUMAYA is not required to verify and inform its customers of applicable customs duties and taxes.


HUMAYA products may be the subject of spontaneous promotions. The duration of the promotional operation will be specified on the home page of the site


The customer can place an order on the website


  1. A) Order process

Orders are placed and received only via the internet and processed by HUMAYA.

  1. To place an order, the customer must choose the product(s), add them to the virtual basket, indicating the desired quantities as well as the size(s), click on the “Add to basket” button.

The Customer must go to the “Basket” page and once the contents of the basket are verified, they must click on the “Confirm my order” button.


The Customer must then enter their email address to log in, create an account or continue as a guest.


If the Customer has an account, he must fill in the “password” field then click on the “connect” button.


If the Customer does not have an account, he must respond to HUMAYA's proposals to receive promotional offers by email then click on the “order now” button.


The Customer must then fill in the “your address” field.


Then, the Customer must send their contact details: name, first name, date of birth, telephone number and click on the “validate” button.


  1. The Customer must choose one of the delivery methods offered.


Before clicking on the “Validate” button, the Customer has the possibility to check the details of his Order and its total price and to return to previous pages to correct any errors or possibly modify his Order.


  1. The Customer must select one of the payment methods offered and provide the necessary information.


Confirmation of the Order entails acceptance of the General Terms and Conditions and formation of the contract with HUMAYA.


Any order constitutes acceptance of the prices and description of the items available for sale.


An Order confirmation email is sent by HUMAYA to the Customer, with the order summary.

HUMAYA reserves ownership of the items until full payment of the order, i.e. receipt of the order price by HUMAYA.


  1. B) Modification of the order after confirmation


Any modification of information transmitted during the order process requested after confirmation thereof is subject to acceptance by HUMAYA which will make its best efforts to verify whether the modification is feasible and any additional costs.


  1. C) Validation of the order


HUMAYA reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.


HUMAYA reserves the right to refuse any order for legitimate reasons and, more particularly, if the quantities of products ordered are unavailable or abnormally high for buyers who are consumers.


HUMAYA undertakes to honor orders received on the website only within the limits of available stocks.


In the absence of availability of one or more item(s) ordered, HUMAYA undertakes to inform the customer as soon as possible, and if necessary, to reimburse him at the latest within 14 days following the payment of the amounts paid. The customer's order will then be automatically canceled.



Delivery is offered by HUMAYA in mainland France.

The customer can choose from the following 3 delivery methods:

  • Home delivery (Delivery between 2-4 working days) ,
  • Delivery to a relay point (no obligation to purchase from the selected merchant) - (Delivery between 3-4 working days)
  • Delivery by Chronopost for France (Delivery within 24 hours)

The products are shipped to the delivery address indicated by the customer when ordering.

The average time for receipt of an order for which delivery has been requested to an address located in mainland France is 3 working days from the order date.

HUMAYA undertakes to make its best efforts to deliver the items ordered and paid for by the customer within the scheduled time frame.


If said items have not been delivered within 7 working days from the delivery date planned when ordering, and if this overrun is not due to a case of force majeure or due to a fact relating to the delivery service provider (in particular in the event of an option for delivery to a relay point), the customer may proceed to resolve the sale by sending an email to the address

The amounts paid by the customer will then be returned in full.


Upon receipt of his order, the customer will ensure to check the conformity of the products received.


Any anomaly concerning the items (damage, missing item compared to the order form, damaged or opened package, broken, defective item, etc.) must be notified to HUMAYA, by email or directly via the contact form on the page " Contact us " .

Any complaint made after a period of 72 hours will be rejected and HUMAYA will be released from all liability.


If the aforementioned conditions are met, HUMAYA will then reimburse the defective product(s), the customer will be able to reorder and then HUMAYA will reship the missing product (subject to the merits of the customer's request).


All items offered by HUMAYA are subject to the legal guarantee provided for by articles 1641 et seq. of the Civil Code. (See Guarantee paragraph)

Payment validation


Payment is validated upon receipt of additional information requested in the event of payment by bank card requiring additional verifications (See paragraph Fighting against bank card fraud).


Payment of the Order by the Customer is irrevocable, subject to the right of withdrawal, and constitutes the conclusion of the sales contract with HUMAYA.

Once payment has been made, and final validation of the order, an email confirming the order, indicating the products ordered and a possible delivery date will be sent to the Customer.

The order will only be considered final once HUMAYA sends the confirmation email, and the sale of the product(s) will only be noted after payment of the corresponding price.

In the event of delivery of products and non-payment, HUMAYA reserves the right to claim ownership of the delivered product(s).



HUMAYA implements all means to ensure the confidentiality and security of data transmitted on the web and on the website


HUMAYA may occasionally offer “promo codes” to reduce the price of certain products or delivery services.

It is up to the customer to insert the promo code when placing the order on the payment page.

Each promotional code has its own conditions which are indicated by HUMAYA in the presentation of the code (either on the website or by email).

The promo code cannot be combined with other current promotions, except when HUMAYA specifies it.

The promo code may be limited to a specific portion of the products sold on the site.

If a promotional code is not used correctly (abuse or in the event of a technical problem) HUMAYA reserves the right to cancel, modify or suspend it, without this having any impact on orders already confirmed by HUMAYA.


HUMAYA reserves the right to verify the personal data communicated by the customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent payments.

This verification may take the form of a request for proof of identity and/or address and/or bank documents (RIB or canceled check). The lack of response from the customer to a request of this type within 2 days following the request made by HUMAYA will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint.

HUMAYA will also have complete freedom to proceed with the direct cancellation of an order which presents one or more risk factors of fraudulent use of a bank card.


In accordance with the law in force (article L221-18 of the Consumer Code), the customer has a right of withdrawal which allows him, within 14 days from the conclusion of the contract, to withdraw without having to provide reasons or pay penalties.


The Customer who wishes to withdraw from an order placed on the HUMAYA website must therefore send, within 14 days of receipt of their order, the form below completed to the email address: hello@humayaparis. com

The Customer must also follow the HUMAYA product return process as defined below to obtain a refund for their order.


Deadline for returning an item 

In accordance with current law (article L121-20 of the Consumer Code), the customer has a period of 14 days to return a product ordered remotely from the date of receipt of the product and without having to provide proof of reasons or to pay penalties.


Return costs to a relay point are free thanks to the return label downloadable from the customer account.


The customer will be fully reimbursed for the sums paid for the purchase of the product as soon as possible and at the latest within 15 days following the date on which he exercised his right of withdrawal.

Return conditions for refund

The returned item(s) must be new and unused. They must be returned in their original, undamaged box.


Without the packaging, it will not be possible for HUMAYA to identify the references of the returned product and put it back into stock.


The product may also be damaged during transport. It is therefore essential to return it in the original box to ensure reimbursement.


HUMAYA will issue a refund within 14 days of receipt of the returned product(s) at our warehouse.

The customer must keep proof of delivery of the package which will be given to him by the carrier. In the event of loss of the package, no refund can be made without this proof of deposit.


The customer has a period of 15 working days from the date of submission of their return package in order to make any complaint relating to their return.


No request will be accepted after this deadline.

The customer must send their complaint directly via the contact form on the “Contact us” page .

Condition of items

All returned items (shoes, original packaging, accessories, instructions, etc.) must be returned perfectly intact.


Upon receipt of the package, HUMAYA will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned items have been visibly used or damaged by the customer and this use or damage renders the items unfit for sale.


If the return is refused by HUMAYA, the items will then be returned to the customer at HUMAYA's expense without the customer being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the goods. sold.

Reimbursement of returns

Subject to compliance with these return conditions, HUMAYA will reimburse the returned items within 14 days following the goods being returned to stock.



HUMAYA is automatically responsible towards the client for the proper execution of the contract concluded with the client.

However, HUMAYA cannot be held liable for non-performance or poor performance of the contract concluded in the event of force majeure, the occurrence of an event attributable to the customer or any inconvenience, unforeseeable and insurmountable damage inherent to the use of the Internet network, in particular a service interruption, an external intrusion or the presence of computer viruses.

The HUMAYA site contains hypertext links that may refer to other websites. HUMAYA cannot be held responsible for the content of these websites if they contravene the legal and regulatory provisions in force.


All items offered by HUMAYA are subject to the legal guarantee provided for by articles 1641 et seq. of the Civil Code.


The customer has a period of 3 days from receipt of the items to form any reservations or complaints for non-conformity or apparent defect of the items delivered, by e-mail via the contact form; or by registered mail with acknowledgment of receipt to the following address: Humaya, Customer Service, 30 rue de la Croix Bosset, 92310 Sèvres.


After this period and failing to have complied with this formality, the items will be deemed to be compliant and free from any apparent defect and no complaint can be validly accepted by HUMAYA.


If the apparent defect or lack of conformity of the item is proven, HUMAYA undertakes to reimburse the customer as soon as possible and at its expense.


This reimbursement will take place within a maximum of 15 days.


HUMAYA cannot, however, be held responsible for the misuse and/or intensive use of the articles that the customer may make of them.

In accordance with current law:


The consumer has a period of two years from delivery of the goods to obtain implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.


The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience for them.


If the item is repaired within the framework of the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.


If the consumer requests repair of the good, but the seller requires replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good.


The consumer can obtain a reduction in the purchase price by keeping the goods or end the contract by being reimbursed in full against return of the goods,


  1. The professional refuses to repair or replace the goods;
  2. The repair or replacement of the goods takes place after a period of thirty days;
  3. The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant good, or if he bears the costs of installing the repaired or replacement good ;
  4. The non-compliance of the property persists despite the seller's unsuccessful attempt to bring it into compliance.


The consumer also has the right to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies the reduction in the price or the termination of the contract being immediate. The consumer is then not required to request repair or replacement of the goods beforehand.


The consumer does not have the right to cancel the sale if the lack of conformity is minor.


Any period of immobilization of the item for repair or replacement suspends the warranty which remained to run until delivery of the restored item.


The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.


The consumer also benefits from the legal guarantee against hidden defects in application of articles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the item is kept or to a full refund against return of the item.

The parties undertake to call on a mediator in the event of a persistent dispute arising in the context of an operation regulated in these general conditions of sale.


These conditions of online sale are subject to French law. The language of these General Conditions of Sale is French.


In the event of a difficulty arising during the ordering or delivery of HUMAYA items, you are invited to call upon a mediator


If no amicable solution is found, the French courts will have jurisdiction to hear the dispute.
